The Proceeds of Crime Act 2002 is a draconian piece of legislation intended to deprive an offender of any benefit derived from his/her offending. It is a legitimate source of revenue for the prosecution team who are permitted to keep part of the monies raised. POCA not only provided the tools to confiscate assets at the end of a case, but also to forfeit money of dubious origin at any time, to monitor bank accounts and to restrain money and property transactions. The Act also creates distinct criminal offences targteting money laundering in the shape of Sections 327 - 329. This has been an area of considerable change over the past couple of years with considerable judicial criticism being targeted at some prosecution practices. This course aims to provide the busy criminal defence lawyer with an overview of the following areas : The POCA offences (sections 327 - 329); Confiscation under POCA, including benefits and criminal lifestyle; valuation of property (including third party interests); Forfeiture of monies and Deprivation of property.
